King John signed the Magna Carta. But like every legal document, the substance of a contract exists beyond what is written on paper. The paper can be shredded into pieces. But its legal principle exists independent of the written words. Is the rule of law an illusion?
According to Carl Schmitt, sovereignty is defined by exceptions. Powers of prerogatives are required in matters where exceptions ‘have to be made’ because of the right to self-preservation. Exceptions to the rule will inevitably exist. He claims that it is these exceptions that proof the existence of rules.
Justifying contradiction is a form of manipulation. The law is manipulative by nature. Therefore, is the rule of law nothing more than a justification of contradictions that exists in our legal system? If so, what is the point of its existence if exceptions will always be made in society? King John sure signed his name for nothing...
